Road Rage completely down plays the term "murder". David's freedom of speech did not warrant his life to be taken. If you read the court transcripts, Moore, who was blocking the road, didn't even hear David say anything he just saw his mouth move. Moore then chased David and his friends in his car, stopped the car David was in, approached the passenger seat, where David was sitting, and started an altercation. Moore then had time to think, went back to his car, grabbed and concealed an illegal knife, and stabbed David to death. David and his friends did not have weapons of any kind.Definition by Law: A person defending himself from the use of force that is not likely to result in death or serious bodily harm may never use deadly physical force. Manslaughter is defined by an Unlawful killing without the intent to kill. More retrieved a deadly weapon and used it. If others do not have a weapon, this is categorized at Second-Degree Murder.
